Spiegel Sohmer files multiple class actions against various insurers to seek compensation for Quebec restaurateurs wrongfully denied business interruption insurance coverage in relation with the Covid-19 pandemic crisis

In the wake of the propagation of the COVID-19 pandemic, the Government of Québec ordered that restaurants limit their dining room capacity by 50% and that bars temporarily close as of March 16, 2020. Then, amidst a deteriorating health crisis and associated risks, the Government ordered the complete shutting of restaurant dining rooms for an indeterminate period.

Many restaurants and bars seeking relief from the precipitous decline in revenues filed claims with their insurers by invoking the business interruption protection in their policies. Restaurateurs trusted that their business interruption coverage would permit them to mitigate their losses arising from government-mandated social distancing advisories and government-mandated business closures. Unfortunately, numerous insurers who provide coverage for restaurants are refusing to honour their obligations.

Spiegel Sohmer has filed a series of Applications for authorization to institute a class action and to obtain the status of representative targeting various large insurers and seeking compensation for the Province of Québec’s thousands of restaurants and bars that were denied coverage from their insurers.
