Litigation

From the moment we are consulted within the framework of litigation, our energy goes first to developing a pragmatic approach based on maximizing the cost/benefit ratio. In other words, we assess the realistic prospects for success of a file at the outset and advise our client to invest resources accordingly. We assure that the business objectives of the client are clearly identified before determining strategies, tactics and resources for a file.

Transactions

We also are frequently called on to become involved in transactions important to an enterprise, such as:

• sale of assets or shares;
• purchase of assets or shares of a partner or a competitor;
• a merger;
• reorganization;
• transfer of control to the next generation.

With these mandates, our approach is to find ways to accomplish the transaction while assuring protection of the client’s interests consistent with the level of risk the client is prepared to assume. Too often attorneys are perceived as putting the brakes on a transaction; our attorneys, on the other hand, press for success of a transaction.

Commercial agreements

Our commercial group also is involved in negotiation and conclusion of commercial agreements. As well, these attorneys participate in the drafting of contracts governing relations of our clients with their clients and suppliers.

Intellectual property

Finally, we also assist our clients in the manufacturing industry with the protection of intellectual property (copyrights and commercial trademarks), be it proceeding with appropriate registration or with prosecuting persons who contravene their rights.
